Terms of Service

1. General

These Terms of Service (“Terms”) govern the use of the web service “Path of Exile Cluster Jewel Price Checker” (“Service”). By using the Service, you agree to these Terms. If you disagree, do not use the Service.

2. Definitions

• Service — web app for checking prices of cluster jewels in Path of Exile.
• User — an individual using the Service.
• Owner — self-employed Vyacheslav Uvarov.
• Demo version — free version with limited functionality.
• Premium subscription — paid version with full functionality.

3. Subject

The Owner provides access to the Service under these Terms.

4. Use of Service

4.1. Demo (free)

Includes:

• Price check (up to 10 combinations at a time)
• Player check (up to 10 combinations; queue possible; enforced 9–11s delay between requests)
• Craft cost check (up to 10 combinations; queue possible; enforced 9–11s delay between requests)
• Dataset export for simulator
• Load/save results (JSON)
• Filtering

Limitations:

• No more than 10 combinations per check (prices/players/craft)
• Queue may apply for free users; fixed 9–11s delay between requests
• ASH templates export — unavailable

4.2. Premium

Premium (₽999/month) provides:

• Unlimited combinations
• All features incl. player and craft checks
• All exports (simulator, ASH)
• Priority support

4.3. License keys & activations

• One license key can be activated on up to 3 devices / unique IPs.
• Sharing or publishing a key to third parties is prohibited; excessive activations may lead to key blocking.
• We store the list of IPs that activated the key to enforce the activation limit.
• If the activation limit is reached, you can request an activation reset via support.
• The Owner may revoke/block keys in case of violations or suspected abuse.

5. Payment and refunds

Premium subscription is paid via YooKassa (Yandex.Kassa) and Robokassa (robokassa.com).

5.1. Subscription terms

• Premium subscription provides access to all paid features of the Service (see section 4.2).
• The subscription fee is 999 (nine hundred ninety-nine) Russian roubles per month, unless otherwise stated at the time of subscription.
• The subscription continues until canceled by the User.

5.2. Billing

The first payment is charged when the User completes the payment and the payment system confirms it successfully.

Subsequent subscription payments are charged automatically:

• on the same calendar day of each following month as the date of the first payment;
• if that day does not exist in the month (e.g. 31st), the charge is made on the last day of the month;
• the exact time of charge is determined by the payment system and may vary.

5.3. Ways to cancel subscription

The User may cancel the subscription at any time to stop further automatic charges.

Where to find the cancel button: On the main page of the application, click the “Premium active” button — a window with key information will open. The “Cancel subscription” button is located in this window.

How to complete cancellation: After clicking “Cancel subscription”, an email with a confirmation link will be sent to the address used when subscribing. To cancel the subscription, you must open your email and follow the link in that message. Until you follow the link, automatic charges will not stop.

If you have any trouble canceling the subscription, contact the administrator at jj3257063@gmail.com, stating the email address used when subscribing.

Canceling the subscription stops further automatic charges but does not entitle you to an automatic refund of amounts already charged. The paid period remains valid until the end of the current paid month.

5.4. Refunds

Refund requests are considered on a case-by-case basis in accordance with Russian consumer protection law.

• To request a refund, send an email to jj3257063@gmail.com with your email, date and amount of payment, and reason for the request;
• refund requests are processed within 10 (ten) business days of receiving complete information;
• if approved, refunds are made to the same payment method used for the original payment, minus any bank/payment processor fees (where applicable);
• refunds for periods already used may be limited or denied if the service was actually provided.

5.5. Subscription price changes

The Owner may change the subscription price at their discretion.

• Users are notified of any price change at least 10 (ten) calendar days before the next charge, via a notice on the Service and/or by email to the address used when subscribing;
• if the User does not agree with the new price, they must cancel the subscription before the new price takes effect;
• continued use of the Service and failure to cancel after the new price takes effect constitutes acceptance of the new terms.

6. Intellectual property

All materials of the Service belong to the Owner. You must not copy, distribute, reverse engineer, or bypass demo limits.

7. Liability

The Owner is not liable for: accuracy of external data, game changes, downtime, or any damages from use/non-use. The User is responsible for confidentiality of the license key and compliance with these Terms.

8. Privacy & personal data

The Owner does not share Users’ personal data with third parties except where required by Russian law and/or reasonably necessary to provide the Service (subscription management, payment processing, hosting).

Detailed information about what data is collected, for which purposes, how long it is stored and what rights the User has is described in the Privacy Policy.

The subscription flow (including recurring payments) also relies on a separate Consent to personal data processing for subscription, which forms an integral part of these Terms and is applied together with them.

9. Changes

Terms may be updated; continued use means acceptance of the new Terms.
